Excepting the provided in GEN 1.7, the air TFC rules applicable to Brazil are in accordance with Annexes 2 and 11 to the Convention on International Civil Aviation, and with the PROC relevant to the ACFT OPS provided for in DOC PANS - ATM and DOC SUPPS relating to the South American region, both edited by ICAO.
In addition, for the safety of air navigation, the following TFC rules and procedures are also applied in Brazil:

1 TYPES OF FLIGHT PLANS (PLN)
|
1.1 The types of Flight Plan are the following:
|
a) Complete Flight Plan;
b) Abbreviated Flight Plan; or
c) Repetitive Flight Plan.
|
1.2 SUBMISSION OF FLIGHT PLAN
|
1.2.1. The Flight Plan may be submitted in person or through:
a) the Internet;
b) telephone or facsimile; or
c) radiotelephony.
|
1.2.2. When the Flight Plan is submitted in person, through the internet, by telephone or by facsimile, the data must be strictly observed according to the MCA 100-11 (Flight Plan Filling Manual) dispositions, as well as the provisions or any restrictions provided for in the aeronautical publications relevant to the flight concerned.
NOTE: MCA 100-11 uses the Flight Plan filling standards set forth in DOC 4444 - PANS-ATM of the International Civil Aviation Organization.
|
1.2.3. The filling of a Flight Plan through the internet does not imply its immediate acceptance. After sending the flight plan, the user must confirm, via status in the system or confirmation e-mail, if it has been accepted or still needs changes.
|
1.2.4. In case of flights departing from a location without an ATS unit, the pilot-in-command must inform, during his/her first contact with an ATS unit, the actual time of departure, so as to complement the filed Flight Plan, since the Alert System will only be started as of the moment this information is received.
|
1.2.5. The pilot in command of the aircraft is responsible to be aware of all information necessary for the planning of the flight, including the assessment of at least:
a) meteorological conditions (updated weather reports and forecasts) of the aerodromes involved and the route to be flown;
b) the estimated fuel for the flight;
c) the correct level (or altitude) for the route to be flown;
d) alternative planning in case the flight cannot be completed;
e) the flight-related conditions prescribed by the aeronautical publications (IAIP and ROTAER); and
f) the equipment and capacities required for the aircraft and crew.
NOTE: The conditions quoted in "e" above refer, for example, to the operational restrictions of the aerodromes involved, to the conditions related to the operation of the navigation aids of the route, approach and take-off, to the airport infrastructure required for the proposed operation, to the minimum safety altitudes for the route to be flown, to the hours of operation of the aerodromes and ATS organs concerning the flight, etc.
|
1.2.6. The AIS or ATS organs shall consider, upon receiving the Flight Plan, that the conditions verified by the pilot in command comply with the requirements of the regulations in force for the type of flight to be performed.
|
1.2.7. Prior submission of the Flight Plan is compulsory when the flight or part of it is planned to operate:
a) according to Instrument Flight Rules;
b) according to Visual Flight Rules, if it is subject to the Air Traffic Control Service;
c) at an aerodrome where an ATS organ is provided;
d) in a specific airspace or aerodrome, where such submission is required in accordance with aeronautical publications; or
e) in the Air Defense Identification Zone (ADIZ).
|
1.2.8. The Flight Plan submitted is valid for 45 (forty-five) MIN from the EOBT.
NOTE 1: When regulatory suspension of aerodrome operations occurs (due to climatic conditions, partial or total interdiction, etc.), this period shall be considered from the time of the reestablishment of those operations.
NOTE 2: The aircraft may be authorized to take off before EOBT, provided that the ATC organ already has the data of the respective Flight Plan in force and that there is no restriction, depending on the management of the air traffic flow for the route or for the aerodromes of departure and arrival.
|
1.2.9. Only an aircraft pilot or operational flight dispatcher may:
a) personally fill and sign the Flight Plan and its update messages; or
b) by telephone or facsimile, provide Flight Plan data and its update messages.
|
1.2.10. The Repetitive Flight Plan shall be filled and signed by a representative accredited by the operator.
NOTE: The representative accredited by the operator is responsible for the shipment of RPL from the company to CGNA.
|
1.2.11. Only elements accredited by DECEA may submit Flight Plans and their update messages through the internet.
NOTE: The elements accredited by DECEA are those who have already registered in the system, and have received the corresponding access codes to the Flight Plan submission system through the Internet.
|
1.2.12. The pilot of the aircraft, the operational dispatcher or another accredited element is responsible for the data s/he has provided by means of a Flight Plan and its update messages.
|
1.2.12.1. Nevertheless, the pilot in command of the aircraft shall be able to provide the information of the Filed Flight Plan to the ATS organs, whenever requested.
|
1.2.13. The approval status of operators and aircraft for any type of RNAV and/or RNP navigation specifications shall be indicated on the PVC or PVS by inserting letter "R" in item 10 of the Flight Plan Form. In the specific case of RPL, this approval status should be indicated by inserting letter "R" in item "Q" of the RPL, as follows: EQPT/R.
|
1.2.14. The PBN approval status shall be detailed in item 18 of the PVC or PVS or in item "Q" of the RPL, by inserting the alphanumeric characters provided in ICAO DOC 4444 - PANS ATM, limited to a maximum of 8 codes or 16 characters, preceded by the designator PBN/.
|
1.2.15. The approval status of operators and aircraft for the employment of GNSS shall be indicated by inserting letter "G" in item 10 of the PVC or PVS. In case RPL is to be used, this approval status should be indicated by inserting letter "G" in item "Q" of the RPL, as follows: EQPT/G.
|
1.2.16. ACFT in SAR mission do not need to previously submit Flight Plan; however, the pilot must inform the ATS or the ARCC promptly, by radiotelephony, whichever comes first, the ACFT registration number, flight destination, route, flight level/altitude, alternate aerodrome, endurance and number of persons on board.
|
1.2.17. Crossing FIR Estimates (EET):
For flights departing from Brazil with international destinations, all international FIRs overflown and the estimated entry time must be reported.
For international flights landing in Brazil or overflying Brazilian Airspace, the first FIR overflown and the estimated entry time must be reported.
|
1.3 SPECIFIC RULES FOR THE COMPLETE FLIGHT PLAN
|
|
1.3.1.1. The submission of PVC shall be performed at any C-AIS or AIS Unit. This submission can be made in person, using the Complete Flight Plan Form, or by providing the data of this form:
a) through the internet; or
b) by telephone or facsimile.
|
1.3.1.2. The submission of the PVC by telephone or facsimile shall be destined to an AIS Unit located in the same FIR of the place of departure or to the C-AIS of jurisdiction.
|
1.3.1.3. The PVC shall be submitted at least:
a) 45 (forty-five) minutes before the EOBT; or
b) 30 (thirty) minutes before the EOBT if submitted through the internet.
NOTE: In order to manage the air traffic flow, at the discretion of DECEA, different time periods may be applied to certain aerodromes.
|
1.3.1.4. The PVC may be submitted within a maximum of 120 (one hundred and twenty) hours in advance of the EOBT.
NOTE: Restrictions may apply to certain aerodromes, at the discretion of DECEA, in order to manage the air traffic flow.
|
1.3.1.5. If the PVC is submitted before the date of departure of the flight, that date should be inserted in item 18.
|
1.3.2. CANCELLATION, MODIFICATION AND DELAY
|
1.3.2.1. The Cancellation regarding the PVC submitted can be requested while it is valid.
|
1.3.2.2. When, for any reason, a given PVC is cancelled and replaced with a new PVC, a canceling message (CNL) with priority DD shall be sent to the involved organs, followed by the transmission of the new FPL message.
NOTE: This procedure is intended to ensure that the CNL message is received at least simultaneously with the substitute FPL message.
|
1.3.2.3. Modifications and Delays related to the PVC may be requested up to 35 (thirty-five) minutes beyond the EOBT.
NOTE 1: Due to the time required for the processing of a modification (CHG) or delay (DLA) message, it is only possible to use the already modified Flight Plan, after 10 (ten) minutes have elapsed from the submission of the corresponding message.
NOTE 2: Exceptions may be applied to certain aerodromes, at the discretion of DECEA, in order to manage the air traffic flow.
|
1.3.2.4. Data relating to the CNL, CHG and DLA messages of a PVC shall be notified by means of the Flight Plan Update Form or provided by telephone, facsimile or the internet.
|
1.3.2.5. CNL, CHG or DLA messages are only applicable for changes to a Flight Plans that has not yet received an ATC authorization. Thus, if there is any need to change a PVC that has already received such authorization, modifications must be submitted by radiotelephony directly to the ATC organ responsible for the flight.
|
1.4 SPECIFIC RULES FOR REPETITIVE FLIGHT PLAN
|
1.4.1. RPL is the Flight Plan related to a series of individual flights frequently recurrent and regularly operating with identical basic characteristics, filed by an operator for retention and repeated use by AIS/ATS units.
|
1.4.1.1. RPL must be used only for IFR flights, or IFR segments, operated regularly on the same day(s) of consecutive weeks, with at least ten frequencies (repetitions) or everyday in a period of at least ten consecutive days.
|
1.4.1.2. It is compulsory to file RPL for flights subjected to the registration of air transportation services which comply with the requirements contained in items 1.4.1.1 and 1.4.1.3.
|
1.4.1.3. It is considered a basic requirement for application that the RPL data have a high degree of stability, in a way that possible later changes can be easily implemented.
|
1.4.1.4. The application of RPL for international flights requires the establishment of bilateral or multilateral agreements between/among the concerned States.
|
|
1.4.2.1. RPL must be submitted to CGNA, using the internet, as well as, alternatively, by means of a FAX consignment or, further, personally submitted, by means of a printed form (RPL), in two copies, to the following address:

1.4.2.2. The submitted RPL forms shall come into force in the relevant ACC from the date specified in field I of the form and shall remain in force until the date specified in field J, unless they are cancelled at the request of the operator.
|
1.4.2.3. When submitting the RPL listings, the operator or his/ her accredited representative must indicate where the following information can be obtained immediately, if requested:
a) alternate aerodromes;.
b) flight endurance;
c) the total number of persons on board; and
d) emergency equipment
|
|
1.4.3.1. RPL will be processed by CGNA, which will distribute the corresponding listings to the ACC involved and will issue an error report to the companies that use the system.
|
1.4.3.2. The ACC shall inform CGNA by means of an electronic message or, alternatively, by means of a FAX message, the receipt of new listings, as well as indicating any errors, if any, that compromise the authorizations of any RPL.
|
1.4.4. PERIOD FOR SUBMISSION
|
1.4.4.1. Companies must submit the corresponding RPL proposals to CGNA, which shall be valid for each of the periods specified in 4.5, at least ten (10) days before the beginning of each period.
|
1.4.5. VALIDITY OF RPL LISTING
|
1.4.5.1. RPL proposals, after being processed and accepted by CGNA, will be included in a list, updated 3 (three) or 4 (four) times a month, for consignment to the involved organs, with the following validity periods:
a) 10 (ten) days for the listing prior to the effective date of the AIRAC amendment; and
b) 9 (nine) days for the listing coinciding with the effective date of the AIRAC amendment and for the following listing.
|
1.4.6. CANCELLATION, MODIFICATION AND DELAY
|
1.4.6.1. Modification, delay and cancellation messages for a flight of a series provided for in Repetitive Flight Plan shall be submitted within 35 (thirty-five) minutes beyond the EOBT.
NOTE: Exceptions may be applied to certain aerodromes, at the discretion of DECEA, in order to manage the air traffic flow.
|
1.4.6.2. CNL, CHG or DLA messages are only applicable for changes to a Flight Plan that has not yet received an ATC authorization. Thus, if there is any need to change a PVC that has already received such authorization, modifications must be submitted by radiotelephony directly to the ATC organ responsible for the flight.
|
1.4.7. PERMANENT MODIFICATIONS
|
1.4.7.1. Permanent modifications involving the inclusion of new flights, cancellation or modification of flights from the RPL lists shall be submitted in the form of new Flight Plans, within the same period of time as in 1.4.4.
|
1.4.8. SUSPENSION AND CANCELLATION
|
1.4.8.1. When, due to exceptional circumstances, an ACC is required to temporarily suspend the use of a series of RPL within its area of responsibility, the mentioned organ shall immediately inform the air carriers and ATS organs involved.
|
1.4.8.2. When, for any reason, a particular flight of a series of RPL is canceled and replaced by a Complete Flight Plan, a CNL message with priority DD shall be forwarded to the ACC responsible for the commencement of the flight, followed by the transmission of the FPL message.
NOTE: This procedure is intended to ensure that the CNL message is received at least simultaneously with the substitute FPL message.
|
1.5 SPECIFIC RULES FOR THE ABBREVIATED FLIGHT PLAN
|
1.5.1. CRITERIA FOR APPLICATION
|
1.5.1.1. The Abbreviated Flight Plan applies to the VFR flight to be performed entirely in ATZ, CTR, TMA, FIZ or, in the absence of such airspaces, within a radius of 50 km (27 NM) from the departure aerodrome.
|
|
1.5.2.1. The submission of the PVS shall be made to the C-AIS of jurisdiction or, if it exists, to the AIS Office that serves the aerodrome of departure. This submission may be made in person, through the Abbreviated Flight Plan Form (PVS), or by providing the data of this form:
a) through the internet;
b) by telephone, facsimile; or
c) by radiotelephony on the ground, to the ATS organ of the departure aerodrome, only where such means of transmission is explicitly allowed, as informed in aeronautical publications.
NOTE: The AIS Unit that serves the departure aerodrome corresponds to the AIS Office located at the departure aerodrome or, if there is a specific operational regulation or agreement, to the one that is in charge of receiving the PVS from another aerodrome.
|
1.5.2.2. The PVS shall be submitted at least 10 (ten) minutes before the EOBT.
NOTE: In order to manage the air traffic flow, at the discretion of DECEA, different time periods may be applied to certain aerodromes.
|
1.5.2.3. The Abbreviated Flight Plan may only be submitted on the same date of the flight.
|
1.5.3. CANCELLATION, MODIFICATION AND DELAY
|
1.5.3.1. CNL, CHG and DLA messages related to the PVS shall be submitted within 35 (thirty-five) minutes beyond the EOBT.
NOTE 1: Due to the time required for the processing of a modification (CHG) or delay (DLA) message, it is only possible to use the already modified Flight Plan, after 10 (ten) minutes have elapsed from the submission of the corresponding message.
NOTE 2: Exceptions may be applied to certain aerodromes, at the discretion of DECEA, in order to manage the air traffic flow.

1.5.3.2. Data related to CNL, CHG and DLA messages of a PVS shall be notified to the C-AIS of jurisdiction or, if any, to the AIS Office of the departure aerodrome. Such notification may be made in person, through the Flight Plan Update Form, or by telephone, facsimile or the Internet.
|
1.5.3.3. CNL, CHG or DLA messages are only applicable for changes to a Flight Plan that has not yet received an ATC authorization. Thus, if there is any need to change a PVS that has already received such authorization, the modifications must be submitted by radiotelephony directly to the ATC organ responsible for the flight.
|
1.6 Use of RPL between Brazil and Paraguay
|
1.6.1. It shall be applied in accordance with the procedures prescribed in the following ICAO Documents: Annex 2, “Rules of the Air”, and Doc.4444 PANS/ATM 501, “Air Traffic Management”.
|
1.6.2. Operators shall submit the RPL lists and/or their corresponding amendments, according to the means and directions prescribed by each State, at least 15 (fifteen) days in advance of the effective date in order to allow the responsible sector to distribute them to the respective Air Traffic Service units.
|
1.6.3. Permanent cancellations shall be informed, as described in the previous item, with a minimum notice of 15 (fifteen) days.
|
1.6.4. The units designated to receive of the RPL lists must inform the operator, through the adequate means of the receipt and acceptance of their RPL lists or their amendments within 10 (ten) days after the date when the operator has submitted them.
|
1.6.5. The operator must be sure that all the involved units, as designated by the States, accepted his RPL list before its effective date.
|
1.6.6. The operator shall continue to submit, as usual, the Flight Plans, even after the proposed effective date, until receiving the confirmation that the RPL list was accepted by the units designated by the States.
|
1.6.7. The addresses for the submission of the RPL lists and / or their corresponding amendments by the operator are indicated below:

1.7 Use of RPL among Brazil, Argentina and Uruguay
|
1.7.1. It shall be applied according to the procedures contained in the following ICAO documents: Annex 2, “Air Rules” and Doc.4444 PANS/ATM 501, “Air Traffic Management”.

1.7.2. Operators shall submit through the means indicated by each state, the RPL lists and/or their corresponding amendments, at least 15 (fifteen) days in advance of the effective date to the addressees indicated below:

1.10 Use of RPL between Brazil and Peru
|
1.10.1. It shall be applied in accordance with the procedures prescribed in the following ICAO Documents: Annex 2, “Rules of the Air”, and Doc. 4444 PANS/ATM 501, “Air Traffic Management”.

1.10.2. Operators shall submit the RPL lists and/or their corresponding amendments, through the means indicated by the aeronautical authority, at least 20 (twenty) days before the effective date to the following addressees:

1.11 Flight clearance within the Brazilian airspace issued by the General Staff of the Air or by the National Civil Aviation Agency (ANAC).

1.11.1. The flights within the brazilian airspace, with or without landing at the subjacent territory, according to the following characteristics, are conditioned to the previous authorization of the general staff of the air, named AVOEM, or the National Civil Aviation Agency - ANAC, named AVANAC.

1.11.1.1. Flight clearance issued by the general staff of the Air. Foreign (military and public civil) acft, (national and foreign) civil acft, that are equipped with sensors and/or equipment for aero survey or scientific research, for missions for acquisition of data, or not, carrying dangerous cargo, engaged in military operation, and/or warlike material.

1.11.1.2. Flight clearance issued by ANAC (AVANAC). Such national and foreign private civil acft, except those included in the item 1.11.1.1, issued by ANAC itself.

1.11.2. When requesting for avoem, out of the Brazilian territory, the request must be showed to the aeronautical attache certified by the brazilian government, or to the military attache (who also answers for this function), or also, when such authorities are not available, to the foreign authorities certified by the general staff of the air.

1.11.3. When requesting for AVANAC, out of the Brazilian territory, the request must be submitted directly on the ANAC site (www.anac.gov.br) by the carrier or a representative, according to the specific legislation.

1.11.4. The flight authorization number (AVOEM, AVANAC), for authorized foreign military and civil aircraft to overfly and/ or land in the Brazilian territory shall be added to the item 18 of the aircraft PLN, by means of RMK indicative and a slash accompanied by the referred information.
Ex: RMK/AVOEM 123413 (1234 of 2013) or RMK/AVOMD 123413 (1234 of 2013) RMK/AVANAC 1234N13 or RMK/AVANAC 1234N13

1.11.5. The first landing at and the last take off from the Brazilian territory of the foreign acft must be accomplished at international airports.

1.11.6. Foreign private civil ACFT, performing international private air services, do not need the authorization mentioned in item 1.11.1.2 for entry into the Brazilian airspace, with or without landing in the subjancent territory, since:
a) the PLN be presented with 2 (two) hours at least from the hour estimated to enter the airspace under Brazilian jurisdiction,
b) in item 8 of the PLN letter G (general aviation) or letter N (non-scheduled air transport) be ticked off,
c) in item 18 of the PLN the name of the operator or the owner be included, together with his telephone number, FAX and/or TELEX, and
d) ANAC be informed - via registration on the ANAC site (www.anac.gov.br) and prior to flight plan submission - of the location for landing or overflight, informing the estimated date and time of flight, the route and the entrance point in the Brazilian territory, the nationality mark and the aircraft type, the flight purpose and, if it applies, the international airport to be scaled in order to enter the Brazilian territory; and
e) the ACFT hold an AVANAC, in case it lands or intends to proceed to another airport located within the Brazilian territory. The AVANAC number must be registered on item 18 of the PLN, as prescribed on item 1.11.4,since the first take-off within the Brazilian territory and in all other operations, until its exit from the last international airport in the Country.
